For reasons mentioned in the affidavit in support, the notice of motion is allowed and accordingly disposed of in terms of prayer clauses - (a) and (b).

The suit is restored to file. The undertaking of the plaintiff's advocate to remove all office objections and get the notice of motion numbered within one week from today, is accepted and so ordered.
