Mr.Gopal states that petitioner had approached this Court in view of respondent No.1's passing an order dated 23rd December 2008 and taking recourse to provisions to section 142(2A) of the Income Tax Act, 1961. Mr. Gopal further states that said order has been subsequently withdrawn and assessment has been concluded. Therefore, nothing survives in the petition and seeks leave to withdraw the petition. 2.
