Learned Counsel for the Petitioner states that Petitioner has already shifted from the structure in question. Learned Counsel however makes a grievance that instead of showing the Petitioner as eligible, the Petitioner's brother has been shown as eligible. In the circumstances, liberty is granted to the Petitioner to make an Application to the Appellate Authority viz. concerned Additional Collector to decide the eligibility of the Petitioner. If such Application is made within a period of two weeks from today, the eligibility shall be decided within a period of eight weeks thereafter. In the event, the Petitioner is held eligible, necessary consequences shall ensure. 1/2

k 2/2 7 wpl 370.15 os.doc In view of the above, learned Counsel for the Petitioner does not press the Petition and the Petition to stand disposed of accordingly. The statement of learned Counsel on behalf of the Petitioner (upon instructions from the Petitioner who is present in the Court) is recorded that Writ Petition (L) No.33 of 2015 shall be withdrawn within a period of one week from today.
