Learned Counsel for the Petitioner states that Petitioner has already shifted from the structure in question. Learned Counsel however makes a grievance that instead of showing the Petitioner as eligible, the Petitioner's brother has been shown as eligible. In the circumstances, liberty is granted to the Petitioner to make an Application to the Appellate Authority viz. concerned Additional Collector to decide the eligibility of the Petitioner. If such Application is made within a period of two weeks from today, the eligibility shall be decided within a period of eight weeks thereafter. In the event, the Petitioner is held eligible, necessary consequences shall ensure. 1/2

The statement of learned Counsel on behalf of the Petitioner (upon instructions from the Petitioner who is present in the Court) is recorded that Writ Petition (L) No.33 of 2015 shall be withdrawn within a period of one week from today.
