Having heard the representative of the Offcial Liquidator and the learned advocate appearing for the original Petitioner and considering the averments made in O.L.R., the O.L.R. is allowed in terms of prayer clauses (a), (b) and (c) which reads thus:- (a) In view of paragraph 10 of this report, whether this Hon'ble Court would be pleased to permit the Official Liquidator to make 6th attempt to conduct the sale of (1) movable immoveable property of the company (In Liquidation) situated at Zenith House, 30 MIDC Central Road, Andheri (East) Mumbai - 400093 and (2) immovable property at 005, Gr. Floor, Malti story Building, SEEPZ, Andheri (East), Mumbai without quoting Reserve Price;
(b) In view of paragraph 11 of this report, this Hon'ble Court would be pleased approve the "SALE NOTICE" and "TERMS AND CONDITIONS OF SALE", which is annexed hereto and marked as Exhibit - "D-1" and "D-2";
(c) In view of paragraph 8 and 12 of this Report, whether this Hon'ble Court to permit the Official Liquidator to make 6th attempt of sale of the abovementioned properties by way of publishing the Sale Notice in "Free Press Journal" (English) and "Navshakti" (Marathi) and circulated from Mumbai through an advertising agency in addition to upload the sale Pg 1 of 2
5.olr.49.2020.doc notice on the websites of this Hon'ble Court and the Official Liquidator and also be pleased to permit to pay the advertisement charges out of the sale proceeds or out of the funds available to the credit of the Company (In Liquidation), subject to deduction of TDS, if any;" 2.
