... Defendants Mr. Rohan Kadam, with Abhimanyu Khorote, i/b. Desai & Diwanji for Plaintiffs.
Ms. Pooja Kshirsagar, with Ms. Cheryl Fernandes i/b ALMT Legal for Defendants Nos.1, 3 and 4.
Mr. Prakash Sawant, for the Defendant No.5.
Mr. Swapnali Desai, i/b Mehul Shah for Defendant No.9 CORAM: G.S. PATEL, J DATED:
1st July 2016 PC:- 1.
This is Chamber Summons by Defendants Nos. 1, 3 and 4 ("the Applicants") for inspection. Ms. Kshirsagar for the Applicants makes a statement on instructions that her clients have been given inspection by the Plaintiffs of 584 separate drawings. On behalf of the Plaintiffs, Mr. Kadam says on instructions that for the purposes of the Notice of Motion, the Plaintiffs restrict their claim 1 July 2016
915-CHSL-268-2014.DOC and relief to these 564 drawings (of which inspection has been given and which is recorded in the letter dated 31st January 2014 from the Applicants' Advocates).
2.
The relief in the suit is wider and extends to several other drawings in which the Plaintiffs claim rights. The Plaintiffs and the Applicants agree that inspection of these additional drawings will be given at the offices of the Plaintiffs' Advocates on a date to be mutually agreed. I am making it clear that when this inspection is completed, I expect both sides to draw up an agreed list of the drawings of which inspection has thus been given. 3.
In addition, there are certain drawings in the custody of the Prothonotary and Senior Master of this Court. These are or were the Applicants' drawings. They were seized by the Solapur police and are now in the Prothonotary and Senior Master's custody. The Plaintiffs and the Applicants will be at liberty to inspect those drawings in the Court Registry after making an application for that purpose on praecipe with a copy to the opposite side. 4.
The Chamber Summons is disposed of in these terms. No costs.
