This notice of motion is taken out on behalf of the plaintiff for recalling the order dated 12.08.2014 dismissing the suit since nobody was present for the parties. The counsel for the plaintiff states that a copy of the notice of motion has been served upon the defendant and has filed an affidavit of one Lalbuhar Vishnu Sodha affirmed on 20.07.2015 confirming service upon the defendant. The said affidavit is taken on record. For reasons mentioned in the affidavit in support, the notice of motion is allowed in terms of prayer clauses (a) and (b). The suit is restored to file.
