It is stated in the affidavit in support that the plaintiff expired on 14.11.2016 and the chamber summons has been lodged on 13.2.2017, within the 90 days' period. The counsel appearing for the applicants states that the defendant has also expired and the caveat was filed through a Constituted Attorney. The counsel also states that the defendant's legal heirs have been served the chamber summons. Statement accepted. The counsel states that he will file affidavit of service within two weeks from today. KJ

cst39.17-39 For reasons mentioned in affidavit-in-support, Chamber summons is allowed in terms of prayer clause-(a). Amendment to be carried out and amended petition to be served on the legal heirs within three weeks.
