The petitioner has sought to be appointed guardian of the minor child Namrata Ramkrishna Chavan. The father of the minor child has expired. The petitioner has produced his death certificate. The mother of the minor child serves the petitioner as a domestic help. The minor child is 4 years old. She lives with her mother who is her natural and legal guardian. The mother of the child suffered from HIV. She has been cured. However she is not in a good financial position to care for the maintenance, upbringing and education of the child. The petitioner has offered to provide maintenance and education to the child.

The petitioner served in the Merchant Navy until 2009 when he retired. The income of the petitioner is from return on investments.

The petitioner has produced his income tax returns for the years 2012-2013 and 2013-2014. The petitioner has also produced the accounts statement of his bank account with HDFC Bank. The petitioner is seen to be in a fit and proper financial condition to be appointed the guardian of the minor child Namrata Ramkrishna Chavan .

The petitioner is appointed guardian of the person and property of the minor child Namrata Ramkrishna Chavan. Guardianship Certificate be accordingly issued to the petitioner.

The guardianship petition is disposed off accordingly. (ROSHAN DALVI, J.)
