By this notice of motion, the petitioner seeks condonation of delay of 42 days in filing the petition for restoration of the arbitration petition and seeks restoration of the petition, which is dismissed by this Court by an order dated 20th December, 2014 for want of prosecution. None of the respondents have filed any affidavit in reply. 3.

For the reasons recorded in the affidavit in support, the 1/2

nms390-15 notice of motion is made absolute in terms of prayer clauses (a) and (b). Arbitration Petition No.1049 of 2014 is restored to file. The petitioner is directed to remain present through his advocate on the next date of hearing and thereafter on all subsequent dates and shall prosecute the petition without any default.

The notice of motion is accordingly disposed of in the aforesaid terms.
