CORAM : A.S. OKA & SMT. VIBHA KANKANWADI, JJ.

DATE :

20th JULY, 2017 P.C.

1.

Called out for final hearing. The learned advocate for the petitioner has taken out a Chamber Order for seeking discharge. A copy of the Chamber Order is tendered across the bar. A Partner of the advocate for the petitioner has filed an affidavit in support of the Chamber Order setting out attempts made by the learned advocate for the petitioner to seek instructions by addressing communications to the petitioner. In view of what is stated in affidavit in support of the Chamber Order, the learned advocate for the petitioner is granted discharge, by making the Chamber Order absolute. 2.

Looking to the averments made in the affidavit in support of the Chamber Order, it appears that the petitioner is not interested in prosecuting the petition. Accordingly, we dismiss the petition for nonprosecution. Rule is discharged. (SMT. VIBHA KANKANWADI, J) (A.S. OKA, J)
