Affidavit of service of petitioner no.2 affirmed on 6.3.2018 is on record. Though served, none of the respondents are present. No affidavit opposing the chamber summons also is filed. The first amendment being sought is to amend the cause title to the extent that petitioner no.1 which is in liquidation, the applicant seeks to bring on record the Liquidator. So far as 2nd amendment is concerned, the applicant seeks leave to add the words "with monthly rest from 17.12.2007" in paragraph-21 of the Writ petition and in prayer clauses-(c) and (d) of the writ petition. Keeping open the rights and contentions of the respondents, chamber summons is allowed in terms of prayer clauses- (a) and (b) except the words "(ii) consequential amendment in the body of the writ petition".

Amendment to be carried out and amended petition to be served within 2 weeks. Should respondents wish to file reply/additional reply, they may do so and serve a copy upon petitioner within 3 weeks of receiving the amended petition.

3/3 Stand over to 27.4.2018 for final hearing at 3.00 P.M. subject to over night part-heard.

Petitioner to serve copy of this order along with amended petitions. All chamber summons disposed.

NOTICE OF MOTION NO.79 OF 2018 WITH NOTICE OF MOTION NO.81 OF 2018 Mr.Nevatia states that these were Civil applications which petitioners had taken out and they do not survive. Notices of Motion disposed.
