Heard. The proposed Suit is for partition. Defendant No. 3 resides outside Mumbai. A part of the cause of action has arisen in Mumbai and part outside it. I am satisfied that with leave granted under Clause XII of the Letters Patent this Court would have jurisdiction to entertain and try the Suit.
