Heard the learned counsel appearing on behalf of the Petitioner and Respondent Nos.1 and 3.

The Petitioner is seeking an appropriate writ, order and direction for quashing and setting aside the order dated 30.10.2014 which is passed by the Grievance Committee and he is also seeking an appropriate writ, order and direction directing the Respondents to produce the complete answer sheet written by the Petitioner in the subject of Applied Chemistry. The Petitioner is also seeking a direction directing the Respondents to allow the Petitioner to continue with the Semester VI.

The learned counsel appearing on behalf of the University of Mumbai submits that as long as the Petitioner does not clear the other Semesters, he could not get admission to the last year as per the rules of the said Course.

We have seen the answer paper which is annexed at Exhibit 'H'. It clearly indicates that the Petitioner did not answer any of the questions from the question paper. So far as the other grievance of the Petitioner in respect of hearing not given to him by the Grievance Committee is concerned, in our view, in such a case, question of giving hearing to the Petitioner does not arise. Admittedly, the Petitioner has not even bothered to give answers to the questions. We are, therefore, not in a position to grant any relief as prayed by the Petitioner in this petition.
