The Petition is for leave under Clause XII of the Letters Patent. The suit seeks to recover a principal amount of slightly over Rs.2 crores. According to the Plaintiff the term sheet in question was executed in Mumbai where payments were to be made. The cause of action according to the Plaintiff arises in Mumbai. However the Defendant has its address at Panvel. A material part of the cause of action has arisen within the jurisdiction of this Court. I am satisfied that with leave granted under Clause XII of the Letters Patent, this Court will have the jurisdiction to entertain and try the suit.
