Mr. Daver states that the appeal has been filed impugning the leave granted under Clause XII of the Letters Patent but parties have been later adviced that an application for recalling leave granted could have been filed.

Mr. Daver seeks leave to withdraw the appeal and the Interim Application with liberty to move the learned single Judge with application to recall the leave granted under Clause XII of the Letters Patent. 3.

Both Appeal and Interim Application stand dismissed as withdrawn with liberty as prayed.
