On the oral prayer made by the learned counsel for the petitioner, let respondent no.3 be described appropriately. Necessary amendment shall be incorporated by the learned counsel for the petitioner during the course of the day. Reverification is dispensed with. 2.

Mr. More, learned Additional Government Pleader has put in appearance on behalf of respondent nos.1 and 2 and waives service of notice. He, on instructions from Dr. Sanjeevkumar M. Jadhav, General Manager (Technical), who is

401-WP-511-2024 present in Court, has submitted that last date for submission of tender is though today midnight, however, it will be extended till 27th February, 2024.

Let affidavit-in-reply on behalf of respondent nos.1 and 2 be filed by 22nd February, 2024, however, a copy of the said affidavit shall be served upon the learned counsel for the petitioner by 21st February, 2024. Rejoinder thereto, if any, may be filed by the learned counsel for the petitioner by the next date of listing.

Stand over to 26th February, 2024 for admission. 5.

Learned counsel for the petitioner shall give a fresh notice to the respondent no.3 along with copy of this order. At 2.30 p.m.

Before the aforesaid order could be signed, learned Addl. Government Pleader has mentioned the matter and has stated, on the basis of the instructions received from one Mr.Chandrakant Dange, CEO, Maharashtra Medical Goods Procurement Authority, who is present in court, that the subject tender will be cancelled and after re-determining the conditions, fresh tender shall be issued.
