A chart was submitted across the bar by the learned Counsel appearing for the second respondent-Municipal Corporation pointing out that total amount payable by the petitioner towards the arrears of water charges is Rs. 37,452/-. Learned Counsel appearing for the petitioner on instructions states that the petitioner shall pay the said amount within a period of one month from today. We accept the said statement. 2.

In view of what is stated in the reply of Shri Ashok Balasaheb Phapale dated 12th June, 2014 filed on behalf of the second respondentMunicipal Corporation and in particular paragraphs 10 and 11 thereof, SQ Pathan 1/2

wp.610.13.doc nothing survives in the petition in the light of the aforesaid statement made by the learned counsel for the petitioner on instructions. 3.

Accordingly, we dispose of the petition. However, we make it clear that on failure of the petitioner to pay the amount of Rs. 37,452/- within a period of one month from today, it will be open for the second respondent-Municipal Corporation to take action in accordance with law.
