The Petition, for leave under Clause XII of the Letters Patent, is permitted to be urgently mentioned. The urgency is that there is a threat of discontinuation or cancellation of the internet domain name being used by the Petitioner. The Suit itself is filed in respect of the threatened deactivation of three internet domain names. The three internet domain names are used in Mumbai and a material part of cause of action has arisen within the jurisdiction of this Court. Other than the 4th Defendant, the remaining Defendants are outside Mumbai. I am satisfied that with leave granted under Clause XII of the Letters Patent, this Court will have the necessary jurisdiction to try and entertain the suit.
