1] Heard Mr. Prayag Joshi, learned counsel for the applicant. 2] This application filed under section 11 of the Arbitration and Conciliator Act, 1996 (for short, "ACA"), is pending for quite some time. It was adjourned from time to time on the grounds that the parties are trying to amicably settle the dispute. Lastly on 13th February, 2019 this Court passed the following order:- "1. The learned counsel for the parties states that the parties are attempting to come to an amicable settlement and request for time.

2. By consent stand over to 13 March 2019. To be listed under the caption "for filing consent terms".

1 arbap 81 of 2015 3] Learned counsel for the applicant submits that the consent terms have been prepared and disputes can be resolved. 4] Under Section 11 of ACA, the jurisdiction of the court would be to appoint arbitrator. Considering the arbitration agreement, the parties are intending to resolve the disputes out of court, this court can simpliciter permit the applicant to withdraw this application. 5] The petition is accordingly disposed of with liberty to file appropriate application if the disputes are not amicably resolved.
