Mr Sakhare confirms on the behalf of the Applicant / Plaintiff that the cancellation of the agreement for sale for flat No. 705 has been properly effected by the Defendant. He also confirms that the revised undertakings submitted on the last occasion by Mr Deo are in order and may be accepted. The Defendants' Affidavits and revised undertakings are accepted and taken on record. 2.

In view of this, nothing further survives in the present Notices of Motion i.e. 426, 427 and 435 of 2017. The principal Notices of Motion are still pending, three years after the Suit was filed. Mr Sakhare is correct in saying that either the entire matter should be settled or the Notices of Motion to be heard. 3.

Mr Deo wants the Notices of Motion to be heard. 4.

List the three Notices of Motion Nos. 480, 405 and 399 of 2016 together for hearing and final disposal on 31st March 2017 at the end of the supplementary board.
