IN THE HIGH COURT OF JUDICATURE AT BOMBAY

TESTAMENTARY AND INTESTATE JURISDICTION CHAMBER SUMMONS NO. 52 OF 2016 IN TESTAMENTARY SUIT NO. 42 OF 1998 IN TESTAMENTARY PETITION NO. 274 OF 1998 Mrinalini M. Reshamwala ...Plaintiff

Versus

Vimla P. Jobanputra & Anr.

...Defendants Mr. Rajendra Jain, i/b Thakore Jariwala & Associates for the Plaintiff.

Mr. Archan Shah, for Defendant No. 7.

CORAM: G.S. PATEL, J DATED:

21st June 2016 PC:- 1.

The correct appearances of the Advocates not having been given, they are not recorded. The Associate and the staff are directed not to accept any application for speaking to the minutes to correct the appearances.

2.

This Chamber Summons is disposed of by an order dated 24th February 2016. Separately, on 10th June 2016, I allowed a Chamber Order for amendment. That amendment was to be carried 21st June 2016

53-CST52-16.DOC out by 24th June 2016. I not only dispensed with reverification but I gave the Plaintiff ample time of 14 days to carry out the amendment. All that the amendment required was a deletion of the name of the original 7th Defendant and the addition of his heirs as Defendants Nos. 7(a) and 7(b). A correction to their address was also required. 3.

For this utterly trivial amendment, I am now told that yet another week is required. Two weeks have not been enough to do something that cannot take more than 15 minutes. 4.

The request is declined. That amendment is to be carried out immediately in Court. I expect this to be complete in the next 15 minutes.
