Shri Rajda, counsel for the plaintiff states that his instructions are that the applicant has agreed to co-operate with his client in trying to recover the monies payable by defendant nos.1 and 2. Therefore, the plaintiff has no objection to drop defendant no.3 and also for granting the reliefs as sought in the chamber summons.

Shri Bookwala, counsel for the defendants, on instructions, states that the applicant will co-operate to the best of her ability and to the extent possible with the plaintiff but the agreement/consent to co-operate is without Shraddha Talekar PS 1/2

11.chs.320.2011.ss.928.2003.doc prejudice to their rights and contentions in the matter that the plaintiff could not have attached the 8th floor of Joy Residency flats, furnitures and fixtures mentioned therein.

In view of the above, the warrants of attachment dated 10.08.2007 in respect of the flat on the 8th floor of Joy Residency, fixtures and furnitures in the said flat stand lifted/set aside.

In view of the above, the chamber summons stands disposed. All concerned to act on a copy of this order duly authenticated by the Associate of the Court.
