1] The matter was adjourned from time to time and ultimately, on instructions of the parties, the learned Counsel appearing for them, state that the parties have arrived at settlement, reflected in the minutes of the order dated 21st April 2016 which is tendered in court. The same are taken on record and marked "X" for identification. The minutes of the order are signed by the Advocate for appellant as well as advocate for respondent No.1 (contesting parties).

YBG applod81-16 2] As the parties have settled the dispute raised in the petition filed under section 9 of the Arbitration and Conciliation Act, by tendering the said minutes of the order and as it is stated that no third party is affected by this settlement and also there is no issue with regard to authorisation and instructions, the present appeal is, therefore, disposed of in terms of the minutes of the order.

3] In view of disposal of the appeal, the notice of motion does not survive and disposed of accordingly.
