The learned counsel for the applicant submits that they have already served copy of notice on other side. She undertakes to file affidavit of service within two weeks from today. Same is accepted.

This notice is preferred by Claimant under Order XXI Rule 22 of the Code of Civil Procedure, 1908 to execute the award dated 28.4.2012 as the Execution Application was filed beyond two years. 4.
Though respondents are duly served, no one appeared on behalf of them.

Considering the facts stated by the applicant in affidavit in support of Execution Application, I Mohite 1/2
4 n310-15 am satisfied that applicant has made out a case for allowing the notice. Hence, following order is passed:
a) Notice preferred by applicant under Order XXI Rule 22 of the Code of Civil Procedure, 1908 is allowed.
b) Applicant to execute the award dated 28.4.2012 according to law.
