This motion is taken out by the original Plaintiff for recall of a selfoperative order of dismissal of the suit for non-removal of office objections under Rule 986 of the Bombay High Court Original Side Rules and restoration of the suit. For the reasons stated in the affidavit in support of the notice of motion, the motion is made absolute in terms of prayer clause (a). Learned Counsel for the Defendant waives service of the writ of summons. The Defendant to file written statement within four weeks from today.
