This Notice of Motion is taken out for recall of a rejection order passed by Prothonotary and Senior Master under Rule 986 of High Court (Original Side) Rules. There is a delay of 102 days in taking out the notice of motion. The delay is explained in paragraph-7 of an affidavit in support of the notice of motion. For the reasons stated, the delay is condoned and the notice of motion is made absolute in terms of prayer clause -(b). The suit is restored to file. The Plaintiff to remove all office objections within a period of four weeks from today, failing which, the suit shall stand rejected without reference to this Court.
