Mr Ganesh Ambekar , i/b M/s Thakore Jariwala & Associates, for Applicants.
CORAM: G.S. PATEL, J DATED:
5th June 2018 PC:- 1.
The Chamber Summons seeks that the Plaintiff be permitted to bring on record the legal heirs of the deceased 1st Defendant. There is a delay of 20 days to be condoned.
5th June 2018
29-CST51-18.DOC 2.
I am informed in fairness that service report is awaited on Respondents Nos. 6 to 9 the proposed Defendants. As they are the heirs, service before allowing the amendment is not, in my view, strictly necessary. The Chamber Summons is made absolute in terms of clauses (a) and (b).
3.
Amendment to be carried out without need of reverification within two weeks from today. The newly added Defendants will be served within a period for three weeks thereafter. 4.
The Chamber Summons is disposed of in these terms. No costs.
