Heard the counsel and also considered the affidavit in support. Though I am not impressed by the explanation given in the affidavit in support particularly because there is no explanation why applicant took 9 years in one case to pass assessment order, still, applicant being the State of Maharashtra, I am inclined to consider the company application and condone the delay.

Therefore, company application allowed in terms of prayer clauses (a). Liquidator to consider the affidavit of proof of debt and dispose the same in accordance with law.
