This notice of motion has been taken out by the applicants for setting aside the order dated 19th November, 2015 rejecting the appellant's appeal for non-removal of office objection under Rule 986 of the Bombay High Court (Original Side) Rules.

We have perused the affidavit in support of the notice of motion. Uday S. Jagtap

724-16-nma=.doc It is evident from the affidavit-in-support that the advocate for the appellant was under the impression that the objections had been removed. It was only later he learnt that it was not to the satisfaction of the Registry.

In the above view, the present notice of motion has been taken out. We are satisfied with the reasons set out in the affidavit-in-support of the motion and allow the Notice of Motion in terms of prayer clause (a).

It is made clear that the applicant would remove office objections and have the appeal numbered within a period of two weeks from today, failing which this order shall stands vacated without further reference to the Court.
