This Chamber Summons is taken out under Order XXI, Rule 41 of Code of Civil Procedure for direction to the defendant to disclose on affidavit particulars of the properties owned by him, so that the plaintiff can proceed against him for execution of money decree.

Mr. Punalekar, the learned advocate appearing for the defendant points out that the decree was passed on 19th March,

2/3 2002, which is now sought to be executed for the first time on 21st January, 2015. Thus, the execution is clearly barred by limitation. The Chamber Summons is therefore dismissed. (Smt. R.P. SondurBaldota, J.)
