By an order dated 6 October, 2015, it was agreed between the parties that the balance principal amount of US$ 79,657 along with the interest of US$ 34,005.39 aggregating to a total amount of US$ 113,662.39 shall be paid by the Respondent to the Petitioner on or before 31 March, 2016.

Learned counsel appearing on behalf of the Petitioner states, on instructions, that though this payment was not made by the said date, the said sum of US$ 113,662.39 has been duly received by the Petitioner. After receiving this amount, the Petitioner has no further claim against the Respondent Company and, therefore, seeks Pg 1 of 2

901.cp.214.2013.doc leave to withdraw this Company Petition.

In view of the aforesaid statement and considering the fact that the Company Petition is not yet advertised, leave is granted and the Company Petition is dismissed as withdrawn. No order as to costs.
