The Petitioner had to file the Petition because he was allocated Government Medical College, Miraj at the counseling for undergoing a course in M.S. (Opthalmology). Since Medical Council of India had not granted approval to said College to impart

(Opthalmology), the Petition was filed praying that the direction be issued to allocate a college to the Petitioner as per marks obtained at the Common Entrance Test for post graduate admission for the Academic Year 2002 which was recognized by Medical Council of India to impart post graduate degree in Opthalmology.

The nature of the relief sought for required the Petition to be decided in the year 2002 itself. As of today the Petition has rendered infructuous.
