CORAM : B.R. GAVAI & A.S. GADKARI, JJ.
27th March, 2015.
P.C. :
By way of present Writ Petition the Petitioner is seeking to withdraw the proceedings before the learned Co-operative Court. 2.
It is the contention of the Petitioner that the learned Cooperative Court does not have jurisdiction to entertain the suit filed by the society against him.
3.
The grounds raised in the present Petition can very well be raised before the learned Co-operative Court. If the Co-operative Court does not have jurisdiction, the Petitioner can very well satisfy the learned Co-operative Court by making submissions in that regard. 4.
If the order which is sought by the Petitioner is granted, it will be
PNP 2/2 WP763-27.3 restraining the learned Co-operative Court from exercising the jurisdiction vested in it. If the learned Co-operative Court has jurisdiction or not can be decided by the Co-operative Court after hearing the parties. In that view of the matter, we are not inclined to entertain the present Petition. The Petition is dismissed. In view of dismissal of the Petition, no orders on Chamber Summons (Lodg.) No.940 of 2014.
