Heard learned Counsel Mr.Devendra Nawadkar for the claimant. 2.

This is a notice under Order XXI, Rule 22 of the Code of Civil Procedure, 1908. The learned Counsel for the claimant submits that they have already served the copy of notice on respondent. To that effect, they filed affidavit of service dated 1st August 2015 along with Bailiff's report.

Considering the submission of learned Counsel for the applicant/claimant and the averments made in the affidavit, I satisfy that the applicant/claimant has made out a case for allowing the same. 4.

Hence, the notice is allowed.
