Mr.Mehta, learned counsel appearing for the petitioner states that the debts which are the subject matter of the present proceedings are assigned by the petitioner in favour of Kotak Mahindra Bank Limited and seeks liberty to withdraw this petition with liberty to file a fresh petition by the Kotak Mahindra Bank Limited. 2.

The arbitration petition is dismissed as withdrawn with liberty as prayed. It is however, clear that if any such petition is filed by Kotak Mahindra Bank Limited, the issue of maintainability of such petition, if raised by the respondents, can be decided by the Court at that stage. No order as to costs.
