Mr. Ponda for the 1st Defendant makes a statement that, after 24th November 2010, when statements were noted on behalf of the Defendants to the effect that they would not thereafter copy the Plaintiffs' software or tracking tool, or infringe the Plaintiffs' copyright in their software, or pass off their products as those of the Plaintiffs, the Defendants have not in fact engaged in any software development of the kind that was being undertaken when the Suit was filed. In other words, from the time of the 24th November 2010 15th July 2016

918-NMS713-11.DOC order onwards, there has been no software development by the Defendants. This statement is made on instructions from the 1st Defendant, who is personally present in Court. It is noted and accepted as an undertaking to the Court.

Mr. Tulzapurkar states that upon this statement being accepted, the Motion may be disposed of. It is clarified that the previous statements and the present statement will continue as undertaking to the Court.

The Notice of Motion is disposed of in these terms with no order as to costs.
