There is no dispute that the arbitration agreement exists between the parties. Though the arbitration clause provides for the appointment of three arbitrators in case there being no consensus on the name of the sole arbitrator, learned counsel for the parties have agreed for the appointment of a sole arbitrator. The statement is accepted.

By consent of parties, Prof.Dr. Vandana Shivprasad Bhatt, B.E. (Civil) is appointed as a sole arbitrator. 3.

The arbitration application is disposed of in aforesaid terms. No order as to costs.
