Mr. Upadhye, counsel for applicant seeks leave to withdraw the application no.493 of 2006.

Application no.493 of 2006 stands dismissed as withdrawn. BIFR has recommended that this company be wound up. Mr. Upadhye, counsel for respondent states that against that order, the company had filed an appeal being appeal no.113 of 2004 before AAIFR but he is not aware of the status of the said appeal. Mr. Upadhye further states that he has no instructions as to whether any reference has been filed before National Company Law Tribunal in view of repeal of Sick Industrial Companies Act.
