The learned Advocate for the Plaintiff seeks to withdraw the Suit as against Defendant Nos.3 and 5. The Suit against Defendant Nos.3 and 5 is disposed of as withdrawn as against Defendant Nos.3 and 5. 2.
The learned Advocates for the parties have tendered Consent Terms dated 21-04-2016. They submit that the Consent Terms be taken on record and the above Suit be disposed of in terms of the Consent Terms. The Consent Terms are taken on record and marked 'X' for identification. The Consent Terms are signed by the Plaintiff, Defendant No.2 for self and as Partner of Defendant No.1. The Consent Terms are also singed by Defendant No.4. The respective Advocates for the parties have also signed the Consent Terms. The undertakings recorded in the Consent ssp 1/2
sl 112 of 2016 (907).sxw Terms are accepted. The above Suit is disposed of in terms of the Consent Terms, marked 'X'. Refund of Court Fees, if any, as per rules. Notice of Motion (L) No.700 of 2016 also stands disposed of.

The Collector of Stamps, Mumbai is directed to decide the Application which would be filed by Defendant Nos.1, 2 and 4 as provided in Clause 8 of the Consent Terms, within a period of 8 weeks from the date of its filing. 4.
Needless to add that in view of this order, all ad-interim / interim orders passed, stands vacated.
