IN THE HIGH COURT OF JUDICATURE AT BOMBAY
ORDINARY ORIGINAL CIVIL JURISDICTION WRIT PETITION (LODGING) No.545 of 2015 M/s Atul Automobiles ..
..Petitioner.
Versus
The State of Maharashtra & 4 Ors ..
..Respondents.
Mr Madhav J. Jamdar for the Petitioner.
Mr R.R. Bhosale, AGP for the Respondent-State. CORAM : V.M.KANADE & A.R. JOSHI, JJ.
DATE : 3rd March, 2015.
P.C.
The grievance of the petitioner is that the appeal preferred before the Additional Divisional Commissioner, Mumbai has been reserved for passing final order and though a copy of the judgment has not been delivered, respondents have started the process of recovery. We are surprised that though the order in appeal has not been pronounced and a copy of judgment is yet to be delivered, without even waiting for the said order, respondents have initiated recovery proceedings against the petitioner. We, therefore, direct the respondents not to initiate recovery proceedings against the petitioner since a copy of the judgment is not made available to the petitioner and for a period of two weeks thereafter. With this direction petition is disposed of. (A.R. JOSHI, J) (V.M.KANADE, J) Ladda RS
