Mr Shenoy says that he has written instructions from the Defendants to submit to a decree in terms of prayer clauses (a), (b) and (d) of the Suit.

Ms Kamath, therefore, does not press her prayer for damages. 20th April 2017

The Suit is decreed in these terms with no order as to costs. Drawn up decree is dispensed with. Refund of Court Fees, if any, in accordance with the Rules.

The Court Receiver had sealed certain goods. The packets, labels and cartons with the infringing material will be destroyed by the Defendants at their cost within 12 weeks. The Defendants will however be at liberty to remove the contents and to reuse them in non-infringing packaging.

The Court Receiver stands discharged without passing accounts but on payment of his costs, charges and expenses within four weeks from today by the Plaintiffs.

Notice of Motion (L) No. 525 of 2017 does not survive and is disposed of accordingly.
