Heard, learned Counsel for the Petitioner.

By this Leave Petition filed under Clause XII of the Letters Patent, the Petitioner is seeking leave to file the accompanying suit, which is a suit for defamation filed against the Respondents herein. 3.

It is submitted that although the Respondents are located in Delhi, the allegedly defamatory posts were placed on social media platforms Facebook and Tiktok, which could be viewed and accessed in Mumbai, within the jurisdiction of this Court and it is further stated that the Petitioner is a listed company located at Mumbai. 4.

This Court has perused the contents of the petition, as well as the plaint. Considering the specific pleadings in paragraph no. Shrikant Malani

901.LPETN.57.2020.doc 29 of the plaint, this Court is of the opinion that substantial cause of action has indeed arisen within the jurisdiction of this Court and that therefore, leave can be granted.

In view of the above, the Leave Petition is allowed and disposed of.
