This is an application to implead the Applicant as Plaintiff No.1(a) in place of the deceased 1st Plaintiff. There is a very considerable delay in filing the Chamber Summons. This is attributed to the fact that there were disputes between the 1st Plaintiff's heirs inter se and that these were finally resolved only recently with the other heirs consenting to the present application being made.

In view of this, the Chamber Summons is made absolute in terms of prayers (a), (b) and (c) with no order as to costs. 3.
