The learned counsel for the Petitioner, under instructions, seeks leave to withdraw the petition with liberty to file representation to the Assistant Commissioner, 'G' North ward of Municipal Corporation, Mumbai, to redress his grievance raised in the petition. Leave with liberty as prayed for is granted.

The petition is dismissed as withdrawn.

In the event such a representation is filed by the Petitioner, within a period of two weeks from today, the Assistant Commissioner, 'G' North ward shall decide the same as expeditiously as possible and preferrably within a period of eight weeks from the date of filing of such representation.

It is made clear that we have not gone into the merits of the matter and Assistant Commissioner, 'G' North ward shall decided such representation filed by the Petitioner on its own merit and in accordance with law after giving an opportunity of hearing to the Petitioner.
