Heard the learned Advocates appearing for the parties and the following order is passed by consent :

i.

Mr. Nimay Dave, Advocate is appointed as the sole Arbitrator to decide all the disputes between the parties, forming the subject matter of the above Application.

ii.

The disclosure of Mr. Nimay Dave, Advocate under Section 11 (8) read with Section 12(1) of the Arbitration and Conciliation Act, 1996 is taken on record.

iii.

The parties shall appear before the learned Arbitrator in his chambers on 16 th September, 2016 at 5.30 p.m. and obtain necessary directions. iv.

All contentions of the parties are kept open, save and except the

Nitin 2 / 2 contention that the arbitration proceedings are not maintainable. v.

The learned Arbitrator shall endavour to adjudicate the disputes between the parties and pass his Award within a period of six months from the date of this order.

vi.

The cost of arbitration shall initially be borne by the parties equally. vii.

The venue of the arbitration shall be at Mumbai. 2.

In view of this order, the above Arbitration Application is disposed off. 3.

This order shall not prejudice the contentions raised by the parties in any other proceedings between them.
