This Notice of Motion seeks condonation of 122 days delay in seeking to set-aside the self-operating order dated 20.10.2015 passed by the Prothonotary and Senior Master of this court, rejecting the applicant/petitioner's petition under Rule 986 of the Bombay High Court (Original Side) Rules, for failure to remove office office objections on or before 03.11.2015.

spb/ 3nmw430-16.odt An affidavit by Mr. Sanjay Kakati, the authorized signatory of the applicant dated 23.02.2016 has been filed in support of the motion. The affidavit explains the reasons for not removing office objections within time and consequent delay in filing this motion.

Learned AGP Mr. Takke has no objection for the motion being allowed.

Accordingly, the Notice of Motion is allowed in terms of prayer clauses (a) and (b). Time of four weeks is granted to remove the office objections.

Needless to state that if office objections are not removed within the stipulated period of four weeks from today, the writ petition itself will stand dismissed without reference of the Court.
