Ms. Priya, counsel for plaintiff states that plaintiff having lodged its claim with the Resolution Professional of the owner of defendant no.1 vessel, which is defendant no.2, seeks leave to withdraw the suit. Suit dismissed as withdrawn. Refund, if any, of court fees in accordance with rules. All interim applications also stand disposed. Ms. Priya states that defendant no.1 vessel was ordered to be arrested and she is still under arrest. In view of the withdrawal of the suit, Ms. Priya states that the order of arrest to be vacated and the vessel be released. Ms. Priya states that she has taken search of the caveat against release register at 10.45 a.m. this morning and there is no valid and subsisting caveat against release. Statement accepted. In view of the above, the order of arrest stands vacated and vessel be released forthwith.
