Perused the detailed order passed by this Court dated 14th September, 2016. The operative part of the order is reproduced hereunder : "(i)The Court proposes to appoint Ms. Ankita Singhania, Advocate, to decide the disputes between the parties arising out of the Agency Agreement dated 18 th March, 2010.
(ii)Ms. Ankita Singhania, Advocate, shall submit her disclosure on 21 st October, 2016 under Section 11 (8) read with Section 12 (1) of the Arbitration and Conciliation Act, 1996.
(iii)The Advocate for the Applicant shall forward a copy of this order to Ms.
Ankita Singhania, Advocate as well as to the Respondents.
(iv)All concerned to at on an ordinary copy of this order duly authenticated by the learned Associate to this Court.
(v) Stand over to 21 st October, 2016.

Though a copy of the order was served on the Respondents, they have failed to remain present even at this stage. The disclosure of Ms. Ankita Singhania under Section under Section 11 (8) read with Section 12 (1) of the Arbitration and Conciliation Act, 1996 is taken on record and the following order is passed : (i) Ms. Ankita Singhania, Advocate is appointed as the sole Arbitrator to decide the disputes between the parties arising out of the Agency Agreement dated th March, 2010 (Exhibit A to the Application). (ii)The parties shall appear before the learned Arbitrator in his chambers, on 29 th November, 2016 at 05.30 p.m. and obtain necessary directions. (iv)All contentions of the parties are kept open. (v) The cost of arbitration shall initially be borne by the parties equally. (vi) The venue of Arbitration shall be at Mumbai. (vii)In view of this order, the above Arbitration Application is disposed of. (viii)A copy of this order shall be forwarded to the Respondents by Speed Post A.D.
