The application seeks leave under Section 446 of the Companies Act, 1956, for prosecution of case No. CC/IV/37 of 2009 pending before the Cooperative Court, Mumbai. This case is filed by the Applicant against the Company in liquidation and its licensee, M/s Crossword Books Stores Ltd., under Section 91 of the Co-operative Societies Act, 1960. A case for grant of leave is made out in the affidavit in support of the application. Leave is, accordingly, granted in terms of prayer clause (a) of the Company Application. The Company Application is disposed of accordingly.
