Parties to the Arbitration Petition No.282 of 2021 have arrived at settlement. Minutes of Consent dated 01.07.2023 are tendered and taken on record and marked 'X' for identification. Minutes of Consent have been signed by the Petitioner through authorised Signatory and the Advocate for the Petitioner as well as Proprietor of Respondent and the Advocate for the Respondent. 1/3
Appended to the Minutes of Consent are the necessary power of attorney issued by the Petitioner authorising the signatory of the Minutes of Consent to execute the same. The Proprietor of the Respondent is present in Court. This order is passed in terms of the Minutes of Consent marked 'X'.
The undertakings in the Minutes of Consent are accepted as undertakings to the Court.
Arbitration Petition is disposed of in accordance with the Minutes of Consent.
In view of the disposal of the Arbitration Petition, Interim Application No.1947 of 2022 does not survive and is accordingly disposed of.
It is made clear that the Minutes of Consent entered into between the parties by which the Arbitration Petition is disposed of by this order will not be used as a precedent in other matters. A soft copy of the Minutes of Consent will be uploaded as the second order in the matter.
The Registry is to ensure that the hard copy of the signed Minutes of Consent is permanently retained on file as part of the 2/3
record and is not sent for destruction in the ordinary course. Court fees are to be refunded in accordance with the Rules. For the purposes of Section 43 of the Maharashtra Court Fees Act and the proviso to that Section, today's date is the date of making a claim for repayment. The Prothonotary & Senior Master will issue a certificate for a refund of Court Fees computed according to the Rules. He will act on production of an authenticated copy of this order without requiring a separate application.
